6. User-Generated Content
Our services may allow you to submit, post, or transmit content, including but not limited to comments, feedback, and other materials (collectively, "User-Generated Content"). By submitting User-Generated Content, you grant Innerpresencegarden a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the User-Generated Content does not violate these Terms or any applicable laws. Innerpresencegarden is not responsible for any User-Generated Content and does not endorse any opinion contained in such content.
We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms or applicable laws.
7. Payment Terms
Access to certain features of our services may require payment of fees. You agree to pay all fees associated with your use of the services in accordance with the pricing plan you select. All fees are non-refundable unless otherwise stated in these Terms.
Payment will be processed through a third-party payment processor, and you agree to comply with the terms and conditions of such payment processor. Innerpresencegarden is not responsible for any errors or issues arising from the payment processing.
We reserve the right to change our pricing at any time, but any changes will not affect fees already paid for services that have been purchased.
8. Service Modifications
Innerpresencegarden reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Innerpresencegarden will not be liable to you or to any third party for any modification, suspension, or discontinuation of the services.
In the event of a material change to the services, we will make reasonable efforts to notify you. However, it is your responsibility to review these Terms periodically for updates. Your continued use of the services after any modifications constitutes your acceptance of the revised terms.
We may also impose limits on certain features or restrict your access to parts or all of the services without notice or liability.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Innerpresencegarden, its affiliates, licensors, or service providers, or their respective officers, directors, employees, agents, contractors, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the services.
In no event shall Innerpresencegarden’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.
The foregoing limitations of liability shall apply to the maximum extent permitted by law, regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, even if Innerpresencegarden has been advised of the possibility of such damage.
10. Termination
These Terms are effective until terminated by either you or Innerpresencegarden. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Innerpresencegarden may terminate these Terms and your access to the services at any time, without notice, for any reason, including but not limited to your breach of these Terms.
Upon termination, your right to use the services will immediately cease, and you must destroy all copies of any materials obtained from the services. All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Termination of these Terms does not affect any rights or obligations that have accrued prior to the date of termination.
